Terms & Conditions

1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over.
3. Employees (and their immediate families) of the Promoter, Participating Stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Entries into the promotion open at on 1^st October 2026 and close at 11:59pm AEDT on 31^st January 2027 (“Promotional Period”).
5. A Participating Store is any store that stocks the eligible products listed below and has the promotion actively advertised in-store. (“Participating Store”).
6. To be eligible to enter, individuals must purchase, in a single transaction, one (1) or more Hamilton products from the list below (“Eligible Product”) from a Participating Store in Australia during the Promotional Period: (“Qualifying Transaction”)

7. To enter, individuals must then visit www.hamiltonsunandskin.com.au/holidayprize, follow the prompts to the promotion entry page, input the requested details including first name, last name, email, phone number, postcode, upload a photo of your receipt and submit the fully completed entry form during the Promotional Period. For the avoidance of doubt, an individual’s personal details will only be accessible by the Promoter’s nominated third-party promotional agency, on the Promoter’s behalf. Individual personal details will be deleted by the Promoter’s promotional agency at the end of the promotion. The Promoter’s promotional agency will follow the Promoter’s Privacy Policy in the management of individuals personal details, and comply with Australian privacy law at all times (see clause 23 for for information).
8. Only one (1) entry permitted per person and per receipt.
9. Entrants must retain their original participating store purchase receipt(s) as proof of purchase. Failure to produce the proof of purchase for the entry when requested may, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the product purchased, store of purchase, purchase receipt number and that the purchase was made during the Promotional Period prior to or to or on the day of entry.
10. Incomplete, indecipherable or illegible entries will be deemed invalid.
11. If there is a dispute as to the identity of an entrant, the Promoter’s third-party promotional agency reserves the right, in its sole discretion, to determine the identity of the entrant.
12. The draw will take place at Anisimoff Legal, L3/162 Collins Street, Melbourne VIC 3000 on 3^rd February 2027 at 12:00pm AEDT. Winners will be notified in writing by email and phone within two (2) business days of the draw. Winners details (First initial, surname and postcode) will be published at www.hamiltonsunandskin.com.au/holidayprize on 5^th February 2027.
13. The decision of the Promoter or its nominated agency, in relation to any aspect of this promotion, is final and no correspondence will be entered into.
14. The first valid entry drawn will win Flight Centre Gift cards valued to the total of $10,000. This will consist of two (2) x $4000 Flight Centre Gift cards and one (1) x $2000 Flight Centre Gift card.
15. Any ancillary costs associated with redeeming the Flight Centre Gift card are not included. Any unused balance of the Flight Centre Gift card will not be awarded as cash. Redemption of the Flight Centre Gift card is subject to any terms and conditions of the issuer including those specified on the Flight Centre Gift card.
16. Subject to the unclaimed prize draw clause, if for any reason the winner does not redeem the prize by the time specified by the Promoter below, then the prize will be forfeited.
17. Total prize pool value is $10,000.
18. Prize, or any unused portion, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
19. If the prize remains unclaimed by 2^nd March 2027 the unclaimed prize draw will take place on 3^rd March 2027 at the same time of day and place as the original draw, subject to any directions from the relevant state regulatory authority. The winner, if any, will be notified in writing by email and phone within two (2) business days of the draw. Winner details (First initial, surname and postcode) will be published at www.hamiltonsunandskin.com.au/holidayprize on 5^th March 2027.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, fraud or any failure by a participating store to conduct the draw as required, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access, lost physical entry forms, misplaced entry boxes or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged, illegible, indecipherable or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
23. The Promoter’s nominated third party promotional agency will collect personal information ("PI") of entrants on the Promoter’s behalf in order to conduct the promotion for the Promoter and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. All use and handling of PI will be in accordance with the Promoter’s Privacy Policy, which can be viewed at https://www.keypharm.com.au/privacy-policy/. The Privacy Policy contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. PI collected as part of this promotion will not be dislcosed to any entity outside of Australia.
